Unraveling the Legal Gap (Lacuna Legis) in the Copyright Protection of Artificial Intelligence-Generated Works in Indonesia

Abstract


This article examines the legal vacuum in regulating copyright protection for AI-generated works in Indonesia. The problem lies in the absence of clear rules on authorship, ownership of economic rights, use of copyrighted data for AI training, and liability for infringement. Using library research and a philosophical-legal approach, it reassesses the concept of “author” in relation to non-human creation. The findings show that current Copyright Law, which is based on human creativity, is insufficient for generative AI. This creates legal uncertainty, enforcement challenges, and economic imbalance. It also raises a philosophical crisis in copyright principles, making urgent legal reform necessary
