Sistem Pengupahan Model Sayan di Mr Jack Shoes: Tinjauan Fikih Muamalah
Abstract
This research is motivated by a habit of wages that has been going on for a long time among shoe entrepreneurs, namely remuneration given at the beginning before carrying out work. The purpose of this study is to find out how the implementation of remuneration with the Sayan system is carried out at the home industry of Mr. Jack Shoes, Sidoharjo Village, Gedeg District, Mojokerto Regency from the perspective of muamalah fiqh. The research method used is field research, which is descriptive-analytical in nature, namely by describing and analyzing the actual situation in the field, with an empirical normative approach. Collecting data with observation techniques, interviews, and documentation. The data analysis used is inductive. Based on the results of the study, the wage system in Mr Jack Shoes home industry from the perspective of muamalah fiqh is included in the ijarah contract. But for the wage system, the Sayan model is included in the qardh contract. Wages for this model are included in the 'urf. According to the type, in terms of object it is included in 'urf 'amali> because it is an activity that has become a habit in Mr Jack Shoes' home industry, in terms of scope it is included in urf 'a>m because it applies in other shoe business places, in terms of its validity it includes in 'urf sahi>h because this system has become a habit, applies to the public, is accepted by society,and does not conflict with the texts.
